Johnson signs order directing CPD to investigate federal immigration agents’ alleged misconduct

Mayor Brandon Johnson signed an executive order Saturday morning directing Chicago police to investigate alleged illegal activities by federal immigration agents.

During the signing, Johnson said the city must prepare for the possible return of federal agents to Chicago in the spring.

Under the “ICE Notice” order, if CPD officers discover or receive a report that federal agents are suspected of violating state or local law, they must:

  • Document federal law enforcement activities in accordance with CPD policy;

  • Ensure that any body camera footage captured during the incident – including any footage of use of force, detention, injury or other law enforcement activity –
    save;

  • Seek to identify the federal regulatory officer on site, attempt to verify the regulatory officer’s name and badge number, and use body cameras to document credential verification, including any refusal to comply;

  • Complete reports regarding any violations of state or local law by federal agents in accordance with CPD policy;

  • Immediately call emergency medical services and provide assistance to injured persons on scene

The order states that CPD must also provide evidence of any alleged felony violations to the Cook County State’s Attorney’s Office. Additionally, CPD must share data with the public on alleged violations by federal immigration officials.

Johnson’s office said his executive order makes Chicago “the first city in the nation to use local authorities to hold federal immigration agents accountable for misconduct.”

“No one is above the law. There is no such thing as ‘absolute immunity’ in America,” Johnson said in a statement. “The lawlessness of Trump’s militarized immigration agents puts the life and well-being of every Chicagoan in immediate danger. With today’s order, we will issue notices to ICE in our city. Chicago will not stand idly by while Trump floods our communities with federal agents and terrorizes our residents.”
