Eight years after her divorce, Monique Tepe is still dealing with the aftermath of her first marriage.

Just three weeks before Monique and her dentist husband Spencer Tepe were found dead in their Columbus, Ohio, home, Monique had to excuse herself during a night out with friends because of a situation involving her ex-husband, Michael Mackey, according to a probable cause affidavit obtained by People.

McKee is now accused of murdering Monique and Spencer on December 30 as the couple’s two young children slept just feet away.

Three weeks ago, on Dec. 6, during a weekend getaway in Indiana – a week before Monique and Spencer’s fifth wedding anniversary – the events described in the affidavit occurred.

Monique and Spencer went with friends to watch a Big Ten championship football game against their alma mater, Ohio State.

Halfway through the game, Monique suddenly informed everyone she needed to return to her hotel room without explanation, the affidavit said.

Friends later told investigators that Spencer told them that Monique was “upset about things involving her ex-husband,” the affidavit said.

Around the same time, police said, McGee was caught on community surveillance video breaking into the Tepes’ home in Columbus.

He allegedly spent several hours on their property before leaving.

Investigators have not revealed whether Monique and Spencer were aware of the situation, but the testimony describes a history of alleged threats McGee made against Monique over the years.

According to the affidavit, a friend told police that McGee once told Monique that she would always be his wife and threatened to buy the house next door if she left him.

The testimony did not say whether McKee knew he would not be home when he drove more than 400 miles from Illinois to the Terps and their two young children on Dec. 6.

The affidavit states that McGee was riding in the same silver SUV that was later captured on community surveillance cameras when it arrived at the Tepes’ neighborhood in the early hours of Dec. 30, just before the couple was killed in their home.

Police said the same vehicle was seen leaving the neighborhood shortly after Monique and Spencer’s deaths.

Investigators linked McGee to the car and later traced it to a medical facility where McGee worked in Rockford, about 80 miles west of Chicago.

Federal agents took McGee into custody near the facility on Jan. 10, and a grand jury indicted the surgeon a week later on four counts of aggravated murder and one count of aggravated burglary.

Police later said a search of McGee’s property turned up the weapon they believe was used to kill the Tepes.

McGee first appeared in an Ohio court on January 23, when his attorneys pleaded not guilty to all charges.

A friend of Monique and McGee previously told PEOPLE that while she moved on after the divorce, he was still obsessed with his ex-wife.

“He thinks she can’t survive without him. She needs him. That way she can thrive [in her new marriage]which destroyed his fragile little self-esteem,” the friend said.
