Jack SmithThe former Justice Department special counsel claimed in closed-door congressional testimony Wednesday that investigators have evidence “beyond a reasonable doubt” that the president Donald Trump “Criminal” conspiracy to overturn the 2020 presidential election.
Smith made the remarks during opening remarks to members of the House Judiciary Committee on Wednesday.
“The decisions I made in my investigation did not take into account President Trump’s political affiliations, activities, beliefs or candidacy for the 2024 election,” Smith said in opening statements obtained in advance by The Associated Press. “We act based on the facts and the law — a lesson I learned early in my career as a prosecutor.
Smith added that his investigation “uncovered strong evidence that President Trump knowingly withheld highly classified documents after leaving office in January 2021 and stored them in his social clubs, including bathhouses and ballrooms where events and parties occurred.”
Smith’s investigation, which began in 2022, focused on Trump’s alleged efforts to overturn his 2020 election defeat and classified documents stored at Mar-a-Lago. Charges were filed in both investigations, but Trump escaped prosecution because of the Justice Department’s longstanding policy against prosecuting sitting presidents.
The comments are likely to anger Trump, who has insisted for years that he did nothing to tamper with the election.
In October, the president directed his ire at Smith in a Truth Society post, calling him a “criminal,” a “gangster,” and a “loser” who “should be behind bars.”
