After Pretty was shot and killed by a Border Patrol agent on Saturday, Noem claimed without evidence that Pretty intended to “kill law enforcement” and that agents “fired defensively” to protect themselves.
The widely circulated video showed no evidence that Pretty was “brandishing” the weapon before being shot multiple times, as Noem claimed.
“So, you said last night, ‘This looks like a situation where a person arrives on scene to cause maximum harm to an individual and kills a law enforcement officer,'” Ducey said. “Did he say ‘I’m going to kill you,’ or did he leave a note? How do you know that was his intention?”
“Part of the investigation will be hearing from agents, officers and people on the scene,” Noem responded. “But we do know that he came to the scene and obstructed a law enforcement operation that was in violation of federal law. That is a felony. When these agents tried to get him to loosen the jar, when he interacted with them, he became aggressive and resisted them throughout the process. These officers accepted their training, followed their protocols, and were in fear for their lives and those around them.”
Ducey pushed back on Noem’s use of the word “agreement.”
“You mentioned protocol – we’ve been playing a video all morning that shows an officer removing a weapon from Alex Pretty’s waistband or holster, and then he’s walking away with the weapon before the officer starts shooting. It looks like Alex Pretty was disarmed. If he was disarmed, was that a protocol for the use of deadly force?” he asked.
“That’s what this investigation is all about,” Noem said, without mentioning the Department of Homeland Security’s rules about shooting a disarmed person.
“Every video will be analyzed. Everything will be looked at. That’s part of the answer, and I can’t speak to what those officers were thinking,” Noem added. But this happens within seconds. They clearly feared for their lives and took action to protect themselves and those around them. “
