Court Rules Against Doctor’s Appeal In Vince McMahon Evidence Discovery Case

The ongoing civil lawsuit battle between Janelle Grant, Vince McMahon and WWE took on a new dimension last Wednesday.

The Connecticut Court of Appeals denied an appeal by Dr. Caron Kolker and his clinic after Grant’s attorneys asked Kolker to turn over medical records and bills showing McMahon paid Grant’s medical bills, Post-Wrestling reported. Kolker will now be asked to provide evidence that McMahon personally paid for the treatment. The dismissal comes after Connecticut Superior Court Judge David Bothwell, who is presiding over the case, ordered Kolker in December to provide the requested statements. In January, attorneys representing Colker and Peak Wellness Inc. filed an appeal, saying they had produced hundreds of pages of documents and complied with discovery and court instructions in good faith. Representatives for Kolker and Grant could not be reached for comment on the new motion as of this report.

Notably, Grant’s legal action in the lower courts was not a traditional lawsuit but a discovery act: a legal effort to require Kolker to turn over evidence. Kolker’s attorneys tried to argue that the doctor had given Grant enough evidence to file a traditional lawsuit and that it would be inappropriate for the judge to ask Kolker to turn over more evidence. As POST Wrestling points out, the medical records were turned over, but there was a dispute over billing and payment records, specifically those marked “paid” without indicating who paid.

To add more cobwebs to the weaving case, in a separate case, Kolker is suing one of Grant’s attorneys, Ann Callis, and her law firm for defamation. This comes from comments made to the media by Callis, who claimed her client, who she did not identify, received infusions and medication at Peak Wellness. Kolker denies all accusations. The case is currently pending in federal court.
