What are serious and non-serious violations?
A spokesman for the New York State Department of Health said red “serious” violations involve “food sources and conditions, food cooking and storage temperatures, food worker hygiene practices, water and sewage, food pest contamination and the use of toxic materials.”
Serious violations must be corrected at the time of inspection because they contain factors that may lead to foodborne illness.
In New York State, restaurant inspections are not pass or fail.
Non-critical or blue violations are not related to factors that may directly cause foodborne illness, but may negatively impact a restaurant’s operations. These types of violations relate to the maintenance, design and cleanliness of the premises.
Non-serious violations are not as urgent as serious violations and must be repaired according to the timeline given by the health inspector.
How often do health inspections occur in Monroe County?
The frequency of food establishment inspections in New York State depends on the establishment’s risk category and the establishment’s history of compliance with health regulations.
High-risk food companies are inspected twice a year, medium-risk food companies are inspected once a year, and low-risk food companies are inspected every other year.
Examples of high-risk food settings include table service restaurants, diners, and school kitchens where food is prepared—sites with complex food processing processes such as preparing food in advance or reheating and cooling food.
Medium-risk food businesses do not require such complex processes as they offer low-maintenance food items such as pizza, burgers, and sandwiches.
Bars and coffee shops are typically low-risk food service venues because their food service requires minimal preparation.
Inspectors from each county health department are trained by the New York State Department of Health to standardize food establishment sanitation inspections across the state. For information about each county health department, visit health.ny.gov/environmental/water/drinking/ctyadd1.htm.
