Videographer’s footage of yacht owner’s reckless behavior considered ‘strong evidence’ by law enforcement: ‘Not right’

Witnessing a pod of killer whales up close is an amazing thing, and not many of us are lucky enough to encounter them in our lifetime.

However, one boater in Bellingham, Washington, seemed not to get close enough, steering their vessel dangerously close to an orca.

As the NOAA Fisheries website details, any vessel required to maintain a distance of at least 300 yards to either side of the southern killer whales and 400 yards fore and aft during the 2022 incident. It is expected to extend to 1,000 yards in January.

Although these are not Southern Scent Whales but Bigger Killer Whales, it is still necessary for ships to keep their distance. This boater’s 51-foot yacht is well within that guideline and getting closer.

Thankfully, a local wildlife photographer was nearby and captured the entire scene on film, later notifying authorities of the boater’s reckless behavior.

“The high-resolution video provides strong evidence in this case,” said Greg Busch, assistant director of NOAA’s Office of Enforcement, West Coast Division. “We are fortunate that people watching knew what they were seeing was wrong and documented and reported it in detail so we could take action.”

Following a legal settlement, Matt Ryan of Bellingham paid a $1,000 civil penalty.

As the National Oceanic and Atmospheric Administration notes, research shows that boat traffic near orcas can disrupt orcas’ pursuit of prey and cause stress, both of which can have an impact on their survival. If this group were made up of endangered southern retainer whales, these behaviors would be even more problematic for creatures that already have to deal with multiple challenges, such as food limitations and polluted water.

This video highlights the need to respect animals in their natural habitat. Whether it’s a whale in the ocean or a bison in a national park, keeping your distance is critical for your own safety and the safety of the animal.

Seeing these magnificent creatures in the wild is a gift, and irresponsible behavior means we may not be able to admire them for much longer.
