Dear Chairman Cuomo,
It is my understanding that Ms. Ghislaine Maxwell intends to invoke her Fifth Amendment privilege against self-incrimination and refuse to answer all substantive questions in her upcoming testimony before the House Oversight Committee.
This position appears to be inconsistent with Ms. Maxwell’s previous conduct, as she did not invoke the Fifth Amendment when she previously met with Deputy Attorney General Todd Branch to discuss substantially similar topics.
It is my understanding that Ms. Maxwell intended to read out a prepared statement at the outset of her testimony asserting the privilege on a “blanket” basis and to refuse to allow MPs to question her individually through counsel, rather than invoking the privilege on a question-by-question basis.
Therefore, for the sake of clarity, I set out in this letter the questions I intend to raise during Ms. Maxwell’s testimony and ask the Chair to confirm whether she intends to invoke the Fifth Amendment in answer to the following questions:
1. On December 17, 2025, you filed a habeas corpus petition stating that “four co-conspirators” and 25 men who entered the clandestine settlement were not charged during the course of the investigation. Is this statement accurate?
2. In addition to Jeffrey Epstein, who were the four co-conspirators and the 25 men who sexually abused minors on Epstein’s island, New Mexico ranch, or New York residence, and why do you think they were not prosecuted?
3. What information, evidence, or personal knowledge do you have as to why these individuals were not charged or prosecuted by federal authorities?
4. There is ample evidence of a social relationship between you, President Donald Trump, and Mr. Epstein, and there are several photos of you together. Did you or Mr. Epstein arrange, facilitate, or provide President Trump with access to underage girls?
5. After President Trump publicly stated that he would “consider” a possible pardon for you, did you or anyone acting on your behalf discuss with him or his representatives a pardon or commutation in exchange for your silence?
6. What client lists or records did you or Mr. Epstein maintain identifying clients or associates?
7. Please identify any foreign governments or intelligence agencies with which Mr. Epstein shared information or otherwise acted on his behalf, including those associated with Russia and Israel, and describe the nature and purpose of any such relationships.
To avoid any doubt as to the scope of Ms. Maxwell’s Fifth Amendment claims, please confirm that Ms. Maxwell intends to invoke the Fifth Amendment on these issues. Additionally, I request that this document be moved into the official record at the beginning of Ms. Maxwell’s testimony.
