FBI Director Kash Patel came under fire and was accused of not knowing the law after he claimed on Fox News that protesters could not bring loaded guns to demonstrations after a federal agent killed intensive care unit nurse Alex Pretty in Minneapolis, the second such death in the city in recent weeks.
Homeland Security officials claimed Preti was a legal owner of a firearm who possessed weapons and incited violence, but that claim has been disputed by video and sworn testimony.

Fox’s Maria Bartiromo said it feels like the “rhetoric and protests” over the Trump administration’s crackdown on immigration are “only intensifying.”
She asked Patel: “What advice do you have for people who are outraged by this second killing by the Border Patrol in two weeks?”
“You can’t go to any protest you want with a loaded gun,” Patel responded.
“It’s that simple,” he added. “You have no right to break the law.”
A video of Patel’s remarks went viral after being shared on
The clip also received a community note that read: “Under the Second Amendment and Minnesota Statutes Section 624.714, permit holders can legally carry firearms in public, including during protests. The U.S. Supreme Court has ruled that open carry of a firearm is a constitutional right. Carrying a firearm does not legally constitute ‘incitement to violence.'”
This explanation is relevant to Minnesota statutes and Supreme Court decisions supporting this interpretation.
