Driver who killed jogger in 2025 is suing victim’s family for ‘emotional injuries’

A pickup truck driver who struck and killed a jogger last year is suing the victim’s estate, according to a new report.

The driver saw Bailey jogging on the side of the road and moved to give her more room, but did not see Anthony, who was also running on the side of the road, until it was too late, according to a police report seen by the newspaper.

Investigators reportedly said the time of day and rainy weather may have contributed to the crash, but investigators did not issue a ticket to the driver. Local outlet KOLN also reported that the driver remained at the scene and attempted life-saving measures.

According to court records reviewed by KOLN, the driver, Gavin Maas, 25, has now sued Anthony’s estate, seeking compensation of at least $50,000, including mental harm and medical expenses.

Maas reportedly claimed in the complaint that he suffered from post-traumatic stress disorder (PTSD) after the accident and was hospitalized multiple times.

“My earliest interaction with Anthony was at his bedside while working as a nurse in the surgical intensive care unit. Patients adored him and spoke of his attention to detail and compassion,” Dr. Charity Evans said in the release.

Evans added: “We were extremely fortunate to recruit him to join ACS as an advanced practice provider. Anthony will be greatly missed. The way he cared for his patients and supported his colleagues will forever be a role model for us all for years to come.”
