‘Double Jeopardy By Any Common Sense!’

Mangione was back in court Friday following a surprise summons from a Manhattan state judge. Gregory Carlo. It was during this hearing that Carlo set a state trial date of June 8. Mangione is scheduled to face a federal trial in October.

The 27-year-old Ivy League graduate was furious when Manhattan State Judge Gregory Carro set a trial date ahead of a separate October date set by the federal government in the Southern District of New York.

“Same trial twice. One plus one equals two. By any common sense, that’s double jeopardy!” Mangione shouted to reporters as court officials led him out of the room.

Mangione was referring to the Double Jeopardy Clause of the Fifth Amendment, which protects defendants from being prosecuted twice for the same crime.

Karen AgnifiloA member of Mangione’s legal team echoed those sentiments outside court.

“What I’m saying is, double jeopardy is to protect people,” Agnifilo said, “and they’re using it as a weapon. So, it’s unfair.”
