The government has set up a digital competition law panel to examine various regulatory aspects of addressing the challenges posed by the digital economy.
According to the official order, the group, chaired by corporate affairs secretary Manoj Govil, will also examine the need for ex-ante regulatory mechanisms for digital markets through separate legislation.
The formation of the group comes less than two months after a parliamentary group proposed new digital competition laws to curb anti-competitive behavior in digital markets.
According to an order issued by the Ministry of Corporate Affairs on Monday, the chairman of the Competition Commission of India (CCI) will be a member of the panel, in addition to experts from different fields.
Representatives from the Ministries of Commerce, Economic Affairs, Consumer Affairs, Industry and Internal Trade Promotion, and Electronics and Information Technology will also be present.
The panel will examine whether the existing provisions in the Competition Act 2022 and the rules and regulations it imposes are sufficient to meet the challenges posed by the digital economy.
In addition, it will study international best practices in regulation in the field of digital markets, as well as other regulatory regimes/institutional mechanisms/government policies regarding competition in digital markets.
Under the order, the committee will also investigate practices by leading firms/systemically important digital intermediaries (SIDIs) to limit or threaten to cause harm in digital markets.
Other members of the committee include Saurabh Srivastava, Co-Founder of Nasscom and Chairman of India Angel Network, Aditya Bhattacharjea of Delhi School of Economics, Haigreve Khaitan Professor of Economics (retired) of Khaitan & Co, Harsha Vardhana Singh of IKDHVAJ Advisers LLP, Shardul Amarchand Mangaldas & Pallavi Shardul Shroff of Co, Anand S Pathak of P&A Law Offices, Rahul Rai of Axiom5 Law Chamber and Joint Secretary of Corporate Affairs Department.
By order, the chair of the expert group may co-opt any other person as a member/special invitee if required.
