Cognour, a Reagan appointee, was one of the few to speak publicly.
After Cogno ruled that Trump’s executive order to end birthright citizenship was “blatantly unconstitutional,” the judge said the threats started pouring in.
Caughnour told a story about five deputy sheriffs armed with long rifles who were called to his home because they received a tip that he had murdered his wife.
“This was a cruel hoax,” Whitaker said, adding that the next day Cogno received a bomb threat. But, “it doesn’t end there,” he said.
“There was a member of Congress who had a ‘Wanted’ poster,” Cognull said. “It just said ‘Wanted’ in big letters at the top and then a picture of a few of us. It said everything except dead or alive.”
Coughnour called the intimidation “very, very ugly,” adding that he had received dozens, if not hundreds, of death threats.
“Judge Cogno told us the threat came from the turf,” Whitaker said. “He has already sentenced an Al Qaeda bomber and a Montana militia member to need around-the-clock protection. But he said he has never received as many death threats as he did in a birthright citizenship case.
“I’ve been doing this for 44 years,” Cognull said of his backup career. “I’ve never encountered the level of hostility toward the judiciary that existed in this country last year. I don’t think it’s because we made bad decisions. I think it’s because there are people who think they can make a lot of political money by criticizing the federal judiciary.”
